Promptlib Privacy Policy

At Promptlib, we value your privacy and are fully devoted to safeguarding your personal information and using it appropriately in accordance with data privacy regulations. This Privacy Policy applies to our web sites, such as www.promptlib.com, and our Promptlib mobile applications (collectively, the "Promptlib Sites" or "Sites").

This Privacy Policy explains what information we (together with our affiliated companies worldwide) collect and utilize concerning each of our Account holders and non-Account holders (like Site visitors) via the Sites, how we employ that information, and the choices that you have with respect to the information we collect about you. The Sites and our services available through the Sites are collectively called the "Services".

We ask that you take a few moments to read this Privacy Policy before you access or use the Services. By using or accessing the Promptlib Sites, you recognize that you have read and fully grasp this Privacy Policy and our Terms of Service and that they both apply to your use of the Services.

If you do not read and fully comprehend this Privacy Policy, please do not access the Sites or Services. This Privacy Policy is not meant to override the terms of any contract you have with us, or any rights you may have under applicable data privacy laws. 1. What information do we collect?

To offer you the Services, we might collect personal information relating to a recognized or identifiable natural person ("Information"). We collect Information to provide, operate and enhance our Sites and Services, to manage your use of the Site or Services (including your Account, as defined below), and to enable you to enjoy and easily navigate our Site and Services.

Also, we collect your information, for the reasons mentioned below, to provide you with ongoing customer service and technical support, and to boost our data security and fraud prevention capabilities.

1.1. Information you provide us:

When you register for our Services and set up an Account on the Promptlib Sites, we may collect certain information such as your name, age/date of birth, postal address, telephone number, and e-mail address, as well as details related to any connected third-party accounts (such as the e-mail or username for a connected PayPal, Google or Facebook account).

Additionally, if you use certain of our features and services, we may collect credit card information. If you create your Account using login credentials from a third party site or service, we'll be able to access and collect your name and email address and other data that your privacy settings on that third party site or service permit us to access; however, we do not receive or store passwords for these third party sites and services.

We may request access to the address books on your mobile devices, so that we can connect Account holders; however, we will not access your address book without your explicit permission.

1.2. Information collected through your use of the Site or Services.

When you visit or use our Site or Services, including browsing our Site or a User Account, editing your Account and uploading information and content, and/or downloading and using any Site feature or services, we are aware of it and usually gather, collect and record such activities, sessions and related information. This may include using third-party services and "cookies" or other tracking technologies as further detailed in section 5, below.

Our servers keep a record of Log Data for both Account holders and non-Account holders (such as Site visitors) (referred to as a "User"). Log Data may include information such as a User's Internet Protocol (IP) address, mobile device identifier, browser type, operating system, the pages or features of our Services the User browsed and the time spent on those pages or features, search terms, the links on our Services that were clicked, the friends of Account holders who use the Services, purchases made by the User, how often Users click on our advertisements, which files are downloaded most frequently, and which areas of our Site are the most popular and other statistics. We also collect information that your mobile device sends when you use our Services, including user settings, the operating system, as well as information about your use of our Services. We use this information to administer the Services and analyze (and may engage third parties to analyze) this information to further develop, improve and enhance the Services by expanding their features and functionality and tailoring them to our Users' needs and preferences, and to make recommendations.

1.3. Data We Gather from Other Sources

If you create your Account using your log-in details from an external source or platform, we'll be able to access and collect your name and email address and other information your privacy settings on that third party site or service grants us access to, but we never receive or store passwords for those external sites or services.

We are unable to delete or modify any Information that is stored on third-party sources. In addition, We may obtain details about you from external sources, such as (i) security providers, fraud detection and prevention providers to help us screen out Users linked to fraud, and (ii) advertising and marketing partners to monitor, manage and measure our ad campaigns.

2. How do we use such information?

2.1. We use your information for the following purposes: to provide and manage the Services; to strengthen our data security and anti-fraud efforts; to generate collective statistical data and other combined and/or inferred information, which we may use to offer and improve our respective Services; to personalize the advertising and content available on the Promptlib Sites, to send out notices related to the service and promotional information about products and services that may be of interest to you, as well as to conduct research for internal purposes; to assist us in updating, broadening and analyzing our records to identify new Users; to facilitate, sponsor, and offer certain competitions, events, and promotions, monitor performance, contact winners, and grant prizes and benefits; and to adhere to any applicable laws and regulations.

2.2. We will only use your Information for the purposes set out in Section 2 with your permission and/or if we are satisfied that:

a. Our utilization of your Information is mandatory to carry out a contractual agreement or take steps to arrive at a contractual agreement with you (e.g. to provide you with Services, to provide you with our customer support and technical assistance), or

b. Our utilization of your Information is essential to comply with a pertinent legal or regulatory obligation that we have, or

c. Our utilization of your Information is necessary to support legitimate interests that we have as a business (for example, to sustain and enhance our Services by recognizing user trends and the efficacy of our promotional campaigns and pinpointing technical issues), provided it is carried out at all times in a way that is appropriate, and that respects your privacy rights.

3. How do we share your information?

We may share your information with service providers and others (or otherwise grant them access to it) in the following ways and situations:

3.1. Third Party Service Providers: We may share Information and aggregated information gathered by us with third party service providers whose services and solutions facilitate, supplement and enhance our own. These may include but are not restricted to hosting and server co-location services, communications and content delivery networks (CDNs), data and cyber security services, billing and payment processing services, fraud detection and prevention services, industry analysis, web analytics, e-mail distribution and monitoring services, session recording and remote access services, performance measurement, data optimisation and marketing services, content suppliers, and our legal and financial advisors (collectively referred to as "Third Party Services")

3.1.1. We may share information with Third Party Services for a business purpose such as identifiers, commercial information and other categories as detailed in Section 1.

3.2. Information Disclosed for Our Protection and the Protection of Others. Depending on the local data protection laws, we may reveal Information when required by law or when we believe in good faith that such disclosure is essential in order to conform to applicable law, obey subpoenas, court orders or legal process served on Promptlib, to establish or exercise our legal rights or defend against legal claims, and to protect the property or interests of Promptlib, its agents and employees, personal safety, or the public. In such circumstances, Promptlib may be forbidden by law, court order or other legal process from providing notice of the disclosure, and Promptlib reserves the right not to provide notice in its sole discretion under those conditions.

3.3. Parent Companies, Subsidiaries, and Affiliated Businesses. We may transfer Information within our group of entities, for the aims described in this Privacy Policy. This could involve sharing your Information with Wix.com Inc., our parent company in the United States, or Wix.com Ltd., our parent company in Israel, to facilitate and provide you with our Site or Services. In addition, if Wix or any of its affiliates go through a change in control, such as a merger, acquisition, or the purchase of substantially all of its assets, your Information could be shared with the relevant parties.

3.4. APIs. We offer APIs for third parties to utilize to access various features of our Services and content on our Sites. Some APIs will be used by third parties to access and make use of your Information with the third parties' services however, your Information will not be accessed and used by any third party API user without your permission. We also supply APIs to some of our third-party service providers to help with providing services to us, such as, but not limited to, credit card processing and shipping fulfillment services, and those third-party API users will access and use your Information only for the purpose of providing services to us on your behalf, as noted above under "Third Party Service Providers".

3.5. Information We Disclose with Your Consent or at Your Request. We will share your Information with third-party websites or platforms, such as social networking sites, only with your direct permission or request.

3.6. Social Media Features and Framed Pages: Our Services include certain Social Media features and widgets, such as the "Facebook Like" button, the "Share this" button, or other interactive mini-programs ("Social Media Features"). These Social Media Features can collect data like your IP address or which page you are visiting on our Sites, and may set a cookie to enable them to work properly. Social Media Features are either hosted by a third party or hosted directly on our Services. Your activities with these third-party Social Media Features are governed by their respective policies and not ours.

For clarification, we may share your Information with your explicit consent or if legally required, apart from the ways explained above.

4. Where do we store your Information?

4.1. We, our authorized affiliates and service providers may maintain, process and store your Information in the United States, Europe (including Ukraine), Israel, and other jurisdictions as necessary to provide our Services or as required by law.

4.1.1 For Jobs Applicants, Information will be kept in the United States and Israel, in the applied position's location(s).

4.1.2 All our affiliates and service providers that store or process your Information on our behalf are contractually obliged to protect and secure it, in accordance with industry standards and any applicable legal requirements in their jurisdiction.

4.2. Data Transfer from EU to Non-EU Countries: If you are based in Europe, when we transfer your Personal Information to countries outside Europe, we will ensure that (i) it is protected to a level accepted by the European Commission or (ii) the relevant Model Standard Contractual Clauses are in place. We have certified our compliance with the EU-U.S. Privacy Shield Framework and Swiss-U.S. Privacy Shield Framework. We are committed to applying the Principles in the Privacy Shield Framework to all Information received from EU and Switzerland, respectively. 5. Use of Cookies and Similar Technologies

5.1. Cookie Policy
At Promptlib.com, we use cookies to provide you with a better browsing experience and improve our services. Cookies are small text files that are stored on your device (computer, tablet, or mobile) when you visit our website. We use the following types of cookies on our website:

Essential Cookies: These cookies are necessary for the website to function properly and cannot be switched off in our systems. They are usually set in response to actions made by you, such as setting your privacy preferences, logging in, or filling in forms. You can set your browser to block or alert you about these cookies, but some parts of the website may not function properly.

Analytics Cookies: We use analytics cookies to collect information about how visitors use our website, such as which pages they visit, and how long they spend on each page. This information helps us to improve the website and provide a better user experience.

Your Options

6. Communications:

6.1. Promotional Content: We may use your Information to provide promotional material and messages through email, text messages, notifications within our platform, marketing calls, and other forms of communication from Promptlib or our partners (acting on our behalf). If you would not like to receive such promotional communications, you are free to notify Promptlib at any time or follow the "unsubscribe" or STOP instructions in the promotional messages you receive.

6.2. Service and Billing Messages: We may also contact you with important information regarding our Services, or your use of them. For example, we may send you a notice (through any of the means available to us) if a Service is suspended for maintenance; answer your support ticket or email; remind you of upcoming or late payments for your current or upcoming subscriptions; forward abuse complaints regarding your Account; or notify you of important changes in our Services.

It is essential that you are able to receive such messages. For this reason, you are not be able to opt-out of receiving such Service and Billing Messages unless you terminate your Promptlib account (which can be done by deactivating your Account)

7. Your rights in relation to your information

7.1. You must have control over your Information. We are therefore taking reasonable steps to enable you to access, receive a copy of, update, amend, delete, or limit the use of your Information.

7.2. For security and identity confirmation purposes, we may ask for additional information before we can provide the requested data to you. We reserve the right to charge a fee as allowed by applicable law if your request is manifestly unfounded or excessive.

7.3. You may file a complaint with your local supervisory authority for data protection (however, we still encourage you to first contact us).

7.4. All Promptlib Users can modify and delete their Information by logging in and navigating to their Settings page on the website. There, you can update incorrect information and delete certain data from your profile. You can also alter your permission settings for us to send you e-mail newsletters.

7.5. All Promptlib Users who wish to retrieve their Promptlib Account data or delete their Promptlib data permanently should contact the Promptlib support at [email protected].

7.6. If you have further questions, feel free to reach out to us via online contact or mail (see Section 15). We will make all reasonable efforts to quickly fulfill your request, subject to legally permitted considerations.

7.6.1. Please note that permanently deleting your Account wipes out all of your information from our databases. After the process is completed, you will be unable to use any of your Services, your Account and all its data will be permanently removed, and we will not be able to revive your Account or retrieve your data in the future. If you contact Promptlib Support in the future, the system will not recognize your Account and support agents will not be able to locate the deleted Account.

8. Additional Information for California residents

8.1. If you are a California resident using the Services, the California Consumer Privacy Act ( "CCPA ") may confer the right to request access to and deletion of your information.

8.2. To exercise your right to request access to and deletion of your Information, please refer to the details provided in section 7.

8.3. Promptlib does not transfer user Information for the purposes of sale to third parties in accordance with the CCPA.

8.4. California residents under the age of 18 who have posted content to the Services may request its removal by emailing us at . All requests must be labeled "California Removal Request " in the subject line. In order to process the request, a description of the content must be included, along with sufficient details to enable us to locate it. We do not accept California Removal Requests via postal mail, telephone, or facsimile. If the proper information is not provided, we may not be able to respond. Please remember that your request may not guarantee full or comprehensive removal of the material. It is possible that another user or third party may republish or repost the material.

9. Data Retention

We may store your Information for as long as your Account is active, in accordance with this Privacy Policy or what is needed to provide you with our Services. Even after you deactivate your Account or stop using any of our Services, we may continue to keep your Information as needed to satisfy our legal obligations, address User disputes, prevent fraud and abuse, enforce our agreements, and protect our legitimate interests. When your Information is no longer needed, we will make sure it is securely deleted.

10. Security

10.1. We have taken security steps to protect the Information you share with us, including physical, electronic and procedural measures. We offer HTTPS secure access to most areas of our Services; credit card data shared through our purchase forms is shielded by an SSL/TLS encrypted connection; and we have been awarded the PCI DSS (Payment Card Industry Data Security Standards) certification. Additionally, we are continuously working to improve the security of our Systems and Services and to protect our Users' privacy.

10.2. Despite our efforts, we cannot guarantee the absolute safety and privacy of your Information, or any other content you upload, publish or share with us or others. We therefore urge you to set strong passwords for your User Account and to avoid disclosing any information that you believe may cause you substantial or irreparable harm.

11. Third-Party Sources

Our Services may include links to other websites or services. We are not responsible for such websites or services' data protection practices. We urge you to be mindful when you leave our Services and to read the privacy policies of each website and service you visit before providing any information. This Privacy Policy does not apply to such linked third party websites and services, which are subject to the policies of the third parties.

12. Your Profile Page

12.1. Please be aware that when you set up an Account, your profile page will show your Account username and some statistics about your use of the Services, such as when you became an Account holder, the types of content you have posted, and when you last visited the Sites. It will also display information about the Account holders who visit your profile page, including the names of those Account holders who follow you (if the Account holder has allowed for such display), and the number of visitors to, and views of your profile page or pages containing content you have submitted.

12.2. Any data or content that you post to your profile page, or to any Groups which you are a part of, chat rooms or forums will be publically available to Users, so please take care before you post. The name you choose when creating your Account is visible to all Users of the Services. If you visit another Account holder's profile page, your username will appear on that page. Promptlib is not responsible for, and cannot control, the use of any information or content that you have made public through your use of the Services. You may use the tools we make available via the Services to decide what information about you, including Information, will be visible on your profile page and on the profile pages of other Account holders that you visit. Please note accounts can be created either by individuals or companies. Note that in some cases, we may not be able to remove your Information from such areas.

13. Questions and Complaints

13.1. If you have any queries or worries regarding our collection, application or disclosure of data, or if you think we have not complied with this Privacy Policy or associated data security regulations, please contact us – our details are given at the end of this Privacy Policy.

13.2. Our Data Protection Officer team will assess the complaint and decide if a breach has occurred and what action, if any, to take. We take all privacy complaints seriously and will do our utmost to address your complaint promptly and in line with relevant laws.

14. Revisions and Interpretation

14.1. We may alter this Privacy Policy as needed to meet applicable law and to reflect developments to our information gathering, usage and storage practices. In connection with any revised Privacy Policy, we will adopt any measures needed by applicable law, such as notifying you and obtaining your consent. We suggest you check this page regularly for the newest updates on our privacy policies.
